This Rental Agreement and Release of Liability (“Agreement”) is between Owner and the person signing below (“Renter”) for the rental of the camper identified in Renter's booking (the “Camper”). By signing, Renter agrees to the following terms on behalf of Renter and all members of Renter's party.
The Camper is delivered, positioned, leveled and set up by Owner at the site address provided by Renter, and is removed by Owner at the end of the rental period. Renter is responsible for reserving a campsite or obtaining permission from the property owner, and for ensuring the site is legally permitted for camper use and safely reachable by Owner's tow vehicle. If Owner cannot safely deliver to the site, Owner may decline delivery or relocate the Camper to a nearby suitable spot, and fees may not be refundable.
Renter and Renter's party shall not drive, tow, hitch, unhitch, relocate or otherwise move the Camper for any reason, and shall not adjust stabilizers, jacks, hitch or leveling equipment except as instructed by Owner. Any movement of the Camper by anyone other than Owner is a material breach of this Agreement and Renter is fully responsible for all resulting damage, injury, fines and costs.
Renter understands that camping and the use of a camper involve inherent risks, including but not limited to: slips, trips and falls (including on steps and entry doors); burns, fire, and carbon monoxide or propane hazards; electrical hazards; weather, falling trees and other natural hazards; wildlife and insects; uneven ground; food-borne illness; and the acts of other campers or third parties. Renter knowingly and voluntarily assumes all such risks, known and unknown, for Renter and Renter's party.
To the fullest extent permitted by law, Renter, on behalf of Renter, Renter's party, heirs and assigns, releases, waives and discharges Owner and its owners, family members, employees and agents from any and all claims, demands, losses and liabilities for personal injury, illness, death, or loss of or damage to property arising out of or related to the rental or use of the Camper or the campsite, including claims arising from Owner's ordinary negligence. This release does not apply to Owner's gross negligence or intentional misconduct where such a release is prohibited by law.
Renter agrees to indemnify, defend and hold harmless Owner and its owners, family members, employees and agents from any claims, lawsuits, damages, fines, costs and attorney's fees brought by Renter, any member of Renter's party, guests, or any third party arising out of or related to Renter's rental, use or occupancy of the Camper, or Renter's breach of this Agreement.
Renter accepts the Camper in the condition documented at delivery (including photos taken at drop-off) and agrees to return it in the same condition, ordinary wear excepted. Renter is responsible for all loss, theft, and damage to the Camper and its contents during the rental period, regardless of cause, including damage caused by members of Renter's party, guests, pets or weather when the Camper was not properly secured (windows, awnings, vents, doors). Owner may charge the security deposit and the card on file for repair or replacement costs, cleaning fees, missing items, and lost rental income while the Camper is out of service. Charges exceeding the deposit remain Renter's responsibility.
The following are prohibited: driving, towing or moving the Camper; smoking or vaping inside the Camper; illegal drugs or illegal activity; use by anyone under 21 without the Renter present; exceeding the Camper's stated sleeping capacity; open flames, candles or space heaters inside; modifying the Camper or its systems; subletting or transferring the rental; using the Camper as a permanent residence; commercial use or events without written approval; and pets unless approved in writing (pet policy TBD). Violation may result in immediate termination of the rental without refund and additional fees.
Renter will use propane, electrical, water and sewer systems only as instructed by Owner, keep smoke, CO and propane detectors operational, and promptly report any malfunction, damage or safety issue to Owner. Renter will follow all campground rules and applicable laws.
The rental dates, nightly rate, fees, security deposit and total are as shown in Renter's booking confirmation, and are paid in full at checkout. Fees: (a) Delivery: $150 for up to 50 miles one way, plus $4 per mile one way beyond 50 miles, with a maximum delivery distance of 100 miles; (b) Dump fee: $50 when the delivery site has no sewer hookup (Electric only or No hookups), for emptying the Camper's holding tanks. Renter is responsible for accurately stating the delivery address, distance and hookup type; Owner may charge any difference if they are inaccurate.
A $500 refundable security deposit is charged at checkout to hold Renter's reservation. After the Camper is picked up and inspected, Owner will refund the deposit to Renter's original payment method, less any amounts owed under this Agreement (including damage, missing items, excess cleaning, or other charges described in Section 6). Owner will aim to issue the refund, with an itemized list of any deductions, within [7] days after pickup.
Cancellation is measured from the rental start (scheduled delivery date/time) and must be made in writing to Owner by text to 810-962-4908 or email to kennedychristensenco@gmail.com:
Refunds are issued to the original payment method. Owner may cancel a reservation for safety, weather, mechanical or site-access reasons, in which case Renter receives a full refund. Early departure after delivery does not entitle Renter to a refund of unused nights.
Renter is encouraged to carry personal liability coverage. Insurance / damage protection terms TBD.
Owner may terminate the rental and remove the Camper if Renter breaches this Agreement or if conditions make continued use unsafe.
This Agreement is governed by the laws of the State of Michigan. If any provision is found unenforceable, the remaining provisions remain in full effect. This Agreement is the entire agreement between the parties regarding the rental. Renter confirms they are at least 21 years old (minimum age TBD), have read this Agreement, understand they are giving up substantial rights including the right to sue, and sign it voluntarily.
Renter agrees that typing their full legal name and checking the acceptance box during online booking constitutes their legal electronic signature, with the same effect as a handwritten signature.
